1. Owner and acceptance
Endokaira is operated by Luis Eduardo Rodríguez Ayuso under the commercial name Daelya. By creating an account, using the app or purchasing a subscription, you accept these terms and the Privacy Policy.
2. What Endokaira is
Endokaira is a self-tracking tool for symptoms, pain, context factors and menstrual cycle, with guidance signals and estimates based on your own logs.
3. Not a medical device or medical advice
If you have severe pain, concerning symptoms, clinical questions or an emergency, contact healthcare professionals or emergency services. Do not delay care because of information shown in the app.
4. Use requirements
- You must have legal capacity to accept these terms.
- The app is not directed to users under 16.
- You must provide truthful information and keep credentials confidential.
- You must not use the app for unlawful, abusive or unauthorized professional clinical purposes.
5. Account and deletion
You may use certain features locally or sign in to save or sync information where available. You may request account deletion from the app, by writing to support@daelya.com, or by following the Delete account instructions.
6. Subscriptions and purchases
Some features may require an in-app purchase or subscription. Purchases are managed through Apple App Store or Google Play. Price, term, renewal, cancellation and refund rules are shown by the store before purchase.
Subscriptions renew automatically unless cancelled from your Apple or Google account before the end of the current period. You can cancel renewal through the Apple App Store or Google Play subscription settings. Endokaira cannot directly cancel a store-managed subscription on your behalf.
Refund requests or billing issues for purchases made through Apple App Store or Google Play are normally handled through the relevant store, without prejudice to any statutory consumer rights you may have.
7. Digital content withdrawal rights
If you are a consumer in the EU/EEA, the general withdrawal period for distance contracts is 14 calendar days from the contract date unless a legal exception applies.
For digital content or digital services not supplied on a tangible medium, withdrawal rights may be lost when performance starts during the withdrawal period with your prior consent, your acknowledgement that you lose that right, and the contractual confirmation required by applicable law. For purchases handled by Apple App Store or Google Play, the store may show and record these conditions during the purchase flow.
Cancellation of subscription renewal prevents future charges but does not necessarily create an automatic refund for a period that has already started. This clause does not limit non-waivable consumer rights or refund channels made available by Apple, Google or applicable law.
8. Availability and changes
We may modify, suspend or remove features to improve the app, fix errors, comply with legal requirements or adapt the product.
9. Intellectual property
Endokaira, its design, brand, software, text and content belong to the service owner or licensors. You receive a limited, revocable, non-exclusive and non-transferable license to use the app under these terms.
10. Limitation of liability
Endokaira is provided as is to the extent permitted by law. We do not guarantee health outcomes, exact estimates, uninterrupted availability or absence of errors. Nothing limits non-waivable consumer rights.
11. Governing law
These terms are interpreted under Spanish law, without prejudice to mandatory consumer rights in your country of residence.
